More About Making a Bequest Through Your Will

Your will guarantees that your assets are distributed according to your wishes to the people and causes most important to you.

Including a bequest to All About Animals Rescue in your will is very simple. When you make a will, or update your existing one, ask your solicitor to include a bequest to All About Animals Rescue.

 

The Benefits of a Bequest

  • A bequest from a will or a trust distribution to All About Animals Rescue is fully deductible for federal estate tax purposes, and there is no limit on the deduction your estate can claim. In addition, the gift is usually exempt from state inheritance taxes. In a large estate, your savings can be more than the value of the bequest. You may establish an income-producing planned gift for the benefit of others through your will, thereby reducing your taxable estate. A bequest, whether outright or to fund a planned gift, can be a useful and advantageous addition to your estate plan.
  • It is not payable until death and it does not affect your assets or cash flow during your lifetime.

There are several types of bequests that allow you to designate how your estate will be distributed.

 

Bequests and Bequest Language

Specific Bequest:

You describe exactly what you want to leave to a specific individual or organization and the designated source. If you want to leave a specific dollar amount from a specific source or a particular item (such as an antique or collectorā€™s item), this is the type of bequest that you would use.

ā€œI give $______ (or describe the real or personal property) to All About Animals Rescue, a nonprofit corporation of the State of Michigan, headquartered in Warren, to be used for general purposes as determined by the Board of Directors.”

General Bequest:

This type of bequest does not specify the source from which it should be paid. This gives you executor the flexibility to honor the bequest from any available source.

“I _____ leave $_______ to All About Animals Rescue, a nonprofit corporation of the State of Michigan, headquartered in Warren, to be used for general purposes as determined by the Board of Directors.”

Residuary Bequest:

This type of bequest is honored after all other bequests have been made, and all debts, expenses, and taxes have been paid.

ā€œI give to All About Animals Rescue, a nonprofit corporation of the State of Michigan, headquartered in Warren, all (or ___%) of the rest, residue and remainder of my estate, to be used for general purposes as determined by the Board of Directors.”

Contingent Bequest:

This type of bequest is fulfilled if certain conditions are met. For instance, if your primary beneficiary does not survive you, you can indicate your next choice through a contingent designation.

“I _____ give all the rest, residue and remainder of my real and personal estate to _____, if she/he survives me; if not, then 50 percent equal shares to ______ who survives me and 50 percent to All About Animals Rescue a nonprofit corporation of the State of Michigan, headquartered in Warren, to be used for general purposes as determined by the Board of Directors.”or ā€œI give $___ to (name of beneficiary). If my (name of beneficiary) does not survive me, this bequest will lapse and pass to All About Animals Rescue, a nonprofit corporation of the State of Michigan, headquartered in Warren, to be used for general purposes as determined by the Board of Directors.”
